Please read carefully the following terms and conditions. In completing and submitting the Booking Form, you agree to be bound by these conditions, which form the agreement between BUSHIDO ADVENTURE TRAVEL LTD and you.
1. Booking and payment
To reserve your place on one of our tours, please complete the booking form and submit it with the deposit, which is 10% of the tour price. The deposit will be applied to the tour price or cancellation charges. Balances must be paid by 60 days prior to departure. The tour contract will become valid when BUSHIDO ADVENTURE TRAVEL LTD receives both the booking form and the deposit. The following booking conditions form the basis of your contract with BUSHIDO ADVENTURE TRAVEL LTD (company no. 123456). Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them.
2. Cancellations/refunds
Should you need to cancel your holiday once it has been confirmed, the party leader (or the person(s) concerned in the event of a part cancellation) must immediately advise BUSHIDO ADVENTURE TRAVEL LTD in writing. Your notice of cancellation will only be effective when it is received in writing by us at our offices. Notification may be given by e-mail. As we incur costs from the time we confirm your booking, the following cancellation charges will be payable. Where the cancellation charge is shown as a percentage, this is calculated on the basis of the total cost payable by the person(s) cancelling excluding any amendment charges. Amendment charges are not refundable in the event of cancellation.

3. Single supplement
Trips are organized and priced on a mixture of single room and twin share basis, depending on the type of accommodation being used. Please see the tour notes for details specific to each tour and location. Additional single supplement accommodation may be available (except some locations) at some accommodation for an additional fee. If you book as a single traveller we will automatically pair you with a person of the same gender. For a guaranteed single room you must pay the advertised single supplement rate, subject to availability.
4. If we change your trip
While we will do our best to operate all trips as advertised, we reserve the right to change and correct errors in any of the facilities, services or itineraries described in this brochure and/or on our website at any time before or after your booking is confirmed. Most changes are minor. Occasionally, we have to make a significant change. If a significant change has to be made, we will inform you as soon as reasonably possible, if there is time before departure.
For “Guaranteed Departures”, we promise not to make any significant changes unless we are forced to do so by force majeure (see Force Majeure). Guaranteed departures have a minimum of four people. However, if a trip consists of a group size of 3 or less due to cancellation, we reserve the right to remove the inclusion of a support vehicle where applicable and reduce the number of guides to one. In such a case, the guide will act as tour leader and carry out on spot repairs. Baggage will be forwarded on to every other hotel by courier in such a situation. Where this is the case, we will tell you as soon as we are able to. Any such change(s) will not be a significant change. This guarantee does not, however, apply to any international or domestic flights that may be subject to change or cancellation in accordance with these conditions.
5. If we cancel your trip
We reserve the right to cancel a trip in any circumstances but will not cancel a trip less than 6 weeks before the start of the trip except for force majeure (see clause 7), or your failure to make all payments (including the final balance and any surcharge) when due. Please note, our trips require a minimum number of participants to enable us to operate them. If any trip does not have the minimum number of participants required to make it commercially viable, we are entitled to cancel it. We will notify you or your travel agent of cancellation for this reason not less than 6 weeks before the start of your trip. When the trip is listed as a “Guaranteed Departure”, we are confident we will have the minimum group size and we will not cancel the trip unless forced to do so by force majeure (see Force Majeure). However, for groups with less than 3 participants, we reserve the right to make changes to the number of guides and provision of support vehicle (referred to in clause 5). If we have to cancel, we will tell you as soon as possible. If there is time to do so before departure and the cancellation does not result from your failure to pay, we will offer you the choice of purchasing an alternative trip offered as a result of consolidation or another available trip from us (in either case, paying or receiving a refund in respect of any difference in price) or receiving a full refund of all monies paid to us. We regret we cannot meet any visa, vaccination or similar costs in the event of any change or cancellation by us. Similarly, as you are advised only to book fully flexible transport and other arrangements which can be cancelled or changed without charge until a trip is guaranteed to run, we cannot pay any cancellation, amendment or other charges you may incur in relation to any transport or other arrangements which you have to change or cancel as a result of the cancellation of your trip.
6. Force majeure
Except where otherwise expressly stated in these conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any injury, damage, loss or expense of any nature as a result of “force majeure”. In these conditions, “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include whether actual or threatened war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, disease, fire and all similar events outside our control.
7. Travel and cancellation insurance
You must have travel insurance when you travel with us. You and your belongings are at all times solely at your own risk. You are wholly responsible for arranging your own insurance. You must ensure that you have personal travel insurance with protection for the full duration of the trip in respect of at least medical expenses, injury, death, repatriation, cancellation and curtailment, with adequate and appropriate cover including medical emergency helicopter repatriation. If you make your own arrangements you should ensure that there are no exclusion clauses limiting or excluding protection for the type of activities included in your trip. You must ensure that all travel insurance purchased meets your particular requirements and you should arrange supplementary insurance if need be.
8. Route Changes
Whilst we try to ensure our trips run as advertised, BUSHIDO ADVENTURE TRAVEL LTD reserves the right to:
* Cancel or modify any routes within the tour or objectives set out in the itinerary.
* Substitute different or equivalent routes within the tour in place of cancelled or modified routes.
* Postpone, cancel or delay any such aspect of the tour if it is necessary to do so due to inclement weather, snow or icy conditions or conditions that are otherwise likely to be hazardous or dangerous or due to any other adverse or threatening conditions which may affect the safety of participants and guides of the group.
9. Health and Fitness requirements
To fully enjoy and benefit from your holiday experience, you should be in good health and physical condition. If you have a medical, physical or mental condition you must disclose this to us upon booking. You are also obliged to do the same if your condition changes prior to departure.
10. Assumption of Risk and safety declaration
You acknowledge that:
* Cycling tours by their very nature, compared with conventional holidays, can be more challenging and demanding with a commensurately higher level of risk and involve potential exposure to injury and possibly death.
* The additional dangers and risks associated with adventure travel may include difficult and dangerous terrain, extremes of weather, including sudden and unexpected changes, remoteness from normal medical services and from communications and evacuation difficulties in the event of illness or injury.
* We reserve the right to withdraw any person who in our opinion is likely to endanger themselves or others. We also reserve the right to cancel any activity if we become concerned for any reason for your safety or that of any other person.
* You must follow our instructions and use any safety equipment provided at all times. For the above reasons you accept the inherent and increased dangers and risks associated with the proposed adventure and the accompanying risk of injury, death or property damage or loss.
11. Release and Waiver of Liability
In consideration of BUSHIDO ADVENTURE TRAVEL LTD accepting your booking and in consideration of you being permitted by BUSHIDO ADVENTURE TRAVEL LTD to join the tour to the extent permitted by law, you:
* Release, waive, discharge, hold harmless and agree to indemnify BUSHIDO ADVENTURE TRAVEL LTD and its officers, employees, agents, licensees, guides and other representatives from all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services, loss of profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during your travel in connection with the tour or any activities conducted in conjunction there within unless caused by the willful negligence or wrongful act of BUSHIDO ADVENTURE TRAVEL LTD and its employees: and regardless of the situation or circumstances giving rise to the claim you waive any claims you have, or may at any time have, against Bushido and its employees and you agree, by accepting the additional inherent dangers and risks associated with the tour, not to make any claim against or seek any compensation from BUSHIDO ADVENTURE TRAVEL LTD and its employees in respect of any personal injury, illness or death suffered by you or damage to or loss of property sustained by you as a result of your participation in the tour. To the extent permitted by law, all our liability for damage to your property, disruption to travel plans, or mental injury is excluded.
12. Privacy
The information supplied by you on the booking form will only be used and viewed by BUSHIDO ADVENTURE TRAVEL LTD. However, in the unlikely event of an accident, any special medical or personal information may be supplied to medical or emergency services personnel. From time-to-time, our staff, customers and suppliers may take photographs and video footage of trips in progress, including pictures of our customers. These pictures may be used in future marketing materials and stored physically and digitally. If you do not wish for your family to be filmed or for your pictures to be taken or used in this manner, please us and/or the photographer at the start of your trip.
13. English Law
The contract between us will be governed by English Law and any dispute will be resolved exclusively by the English courts. Our Terms do not affect your statutory rights.

約款および旅行条件書
注意: 日本国外の旅行は、イギリスの有限会社 Bushido Adventure Tours Ltd. が、イギリスの法規制に従って運営します。
お申し込みいただく前に、BUSHIDO(以下「当方」という)とお客様の間に結ぶ旅行契約について、以下の約款および旅行条件をよくお読み下さい。
1. ご予約およびお支払い
ご予約の際には、予約票に必要事項をご記入の上、旅行代金の1割に当たる申込金を添えてお申込みください。お支払いいただいた申込金は旅行代金または取消料の一部として取り扱います。残りの旅行代金は出発日の42日前までにお支払いください。旅行契約は当方が予約票と申込金を受理した時に成立するものとします。銀行振込または現金でお支払いください(「お支払い方法」参照)。
2. お客様による旅行契約の解除および払い戻し
旅行契約の解除を希望される場合は、速やかに書面にてお知らせください。当方がお客様からお知らせを受けた日を基準にして、下記設定の取消料を申し受けます。

4. 一人部屋追加料金
旅行中のお部屋は、現地の宿泊施設によって、一人部屋または二人部屋を基本に設定されています。詳しくは旅行の詳細をご覧ください。ご希望のお客様にはお一人部屋をご用意することも可能です(一部宿泊施設を除く。追加料金要あり)。お一人でご旅行のお客様は、当方で同性の方との相部屋を設定させていただきます。一人部屋を確保されたい場合は、規定の追加料金をお支払いください(空室状況による)。
5. 当方による旅行契約内容の変更
予定通り旅行を遂行するよう最善を尽くしますが、当方は、旅行契約成立前、もしくはその後に、パンフレットやウェブサイトに記載された施設やサービス、旅行日程等の変更や修正を行う権利を保有します。ほとんどは小さな変更ですが、時として大きな変更を余儀なくされることもあります。その場合は、出発前に時間があれば、可能な限り速やかにお客様にお知らせいたします。
「遂行確定」ツアーに関しましては、不可抗力によるやむをえない場合以外は、大きな変更がないことをお約束いたします(7. 不可抗力 参照)。旅行の最小遂行人数は4人ですが、旅行契約取消により人数が3人以下になった場合、荷物運搬用の車両の使用を中止したり、ガイドを一人に減らし、ガイドがツアーリーダーとして現場修理を行ったりする場合があります。その場合、お荷物は宅配サービスにてホテルにお送りします。このような変更がある場合は、分かり次第お客様にお知らせし、ご迷惑をお掛けしないようにいたします。大きな変更は行いません。尚人数の変更により、国際線、国内線のフライトに変更やキャンセルが生じた場合には、当方は責任を負いかねます。
6. 当方による旅行契約の解除
当方はいかなる場合にも旅行契約を解除する権利を保有しますが、不可抗力(7. 不可抗力 参照)または、お客様の期限までの支払いの不履行や不足(支払い残金や追加料金を含む)がある場合を除き、旅行開始の6週間前以降に契約を解除することはありません。旅行の遂行には最少人数が必要なことをご了承ください。いかなる旅行でも、商業的に実現可能な最少人数に達しない場合は、当方から旅行契約を解除する可能性があります。その場合、お客様もしくは旅行代理店に6週間以上前にお知らせいたします。
「遂行確定」の旅行につきましては、最小遂行人数が確保されており、不可抗力(7. 不可抗力 参照)以外の理由で当方が旅行契約を解除することはありません。しかしながら、参加者が3名以下のツアーの場合、当方はガイドの数の変更や、荷物運搬用車両の提供を取りやめる権利を有します (5. 当方による旅行契約内容の変更 参照)。旅行契約の解除が生じた場合は、速やかにお客様にお知らせします。出発までに時間があり、契約の解除の理由がお客様の支払い不履行以外の場合は、代替の旅行や、他の提供可能な旅行をご提案させていただきます(差額に応じて、お支払い、払い戻しが生じます)。または、当方にお支払いいただいた全額を返金いたします。また、当方による旅行の変更、取り消しがあった場合でも、お客様のビザ、ワクチン接種などの費用のお支払いはいたしません。同様に、交通機関などに関しましても、旅行の遂行が確定するまでは、追加料金をかけずに、取消や変更ができるようにしておくことをお勧めいたします。当方は、旅行の取り消しにより発生した、交通機関その他の取消料や、変更手数料はお支払いいたしません。
7.不可抗力
本約款および旅行条件書に明示的に別段の定めがない限り、「不可抗力」により当方がお客様との契約における義務を履行することができない場合、もしくはお客様が傷害、損害、損失などを被ると考えられる場合は、当方はいかなる責任、賠償も負いかねます。 ここでの「不可抗力」とは、当方もしくはサービス提供者がすべての適切な注意を払っても予測、回避しえない、戦争、その危険性、暴動、国内紛争、テロ活動、労働争議、自然災害、原子力災害、悪天候、病気、火事など、当方が関与し得ない一切の事由を含みます。
8. 旅行保険と旅行取消費用保険
旅行参加には旅行保険への加入が必要です。ご旅行中、お客様およびお客様の所持品は全て自己責任での管理となります。必ずお客様の責任で旅行保険にご加入ください。旅行全期間、最低でも医療費、怪我、死亡、帰還、解約や旅行期間の短縮を補償する内容で、救急ヘリコプター輸送などの十分で適切な補償を含む保険の加入をお勧めします。お客様で保険内容を組み立てられる場合は、旅行中の活動に関わる補償が制限または除外されることのないようお確かめください。お客様の必要条件に適しているか保険内容をご確認の上、必要に応じて追加の保険にご加入ください。
9. 旅程の変更
予定通り旅行を遂行するよう最善を尽くす一方、当方は、以下の権利を保有しています。
- 旅程に記載されている経路や内容の取消しおよび変更
- 取消し、もしくは変更された経路に関する、別経路の設定
- 悪天候、積雪、凍結、または危険とみなされる天候が、参加者及びガイドに危害をもたらすと判断された際の、旅行のキャンセル、延期、または遅延
10.健康状態の必要条件
お客様に存分に旅行を楽しんでもらうためにも、健康で良い体調でいていただく必要があります。万が一、医療面、身体的、精神的に条件や事情のある方は予約の際に必ずお知らせください。予約後、出発までに健康状態が変わられた方も、必ずお知らせください。
11.危険の引き受けと安全宣言
お客様には以下の事項について同意していただきます。
‐サイクリングツアーは、従来の旅行と比べ、険しく厳しい性質を持っています。それに伴い危険性が高く、怪我や、さらには死亡の可能性もあります。
‐ 冒険型の旅行に伴う危険性には、難易度の高い危険な地形、極めて厳しい天候、想定外の突然の変更、通常の治療やコミュニケーションからの隔離、病気や怪我の際の救助の難しさなどがあります。
‐ 当方は、ご自身もしくは他のお客様を危険にさらすと判断したお客様に、旅行を離脱していただく権利を保有しています。また、何らかの理由で旅行中の活動の遂行がお客様の安全上問題があると判断した場合は、その中止を行う権利を保有しています。
‐ いかなる時も当方の指示に従い、提供された安全具を着用してください。お客様には上記の理由により、冒険型の旅行特有の危険性やそれに付随する傷害、死、物的損害や損失の可能性を受諾していただくこととします。
12. 免責
当方がお客様の予約を受け入れ、お客様が当方から旅行参加の許可を受けたことを約因として、お客様は法が許す限度で以下の事項に同意します。
当方とその幹部、従業員、代理人、被許諾者、ガイドおよび他の代表者を、傷害、物的損害、不法死亡、サービスおよび利益の損失、結果的、懲罰的損害や旅行やその活動内容に関わる損害に対し、当方とその従業員の意図的または不正行為によって生じた場合を除き、全ての訴訟、請求から免責し、損害賠償を被らないよう保障することに同意します。
いかなる場合にも、当方やその従業員を訴訟する権利を放棄し、旅行に伴う危険性を受け入れます。旅行参加に伴う、個人的な怪我、疾病、死亡、財産の損害について当方やその従業員に賠償請求をしないことを同意します。
法が許す限度で、当方はお客様の財産に対する損害、旅行計画の中断、精神的傷害に対する全ての責任から免除されます。
13.個人情報
予約により発生した個人情報は当方でのみ使用、閲覧されるものとします。しかし不慮の事故などの場合、お客様の医療および個人情報は医療関係者や救助隊に提供されることがあります。また、当方社員、他のお客様やその他関係者が旅行中の写真や動画を撮影する際に、お客様が映る場合があります。それらの写真は当方の営業目的に使用されたり、印刷物、データとして保存されたりします。お客様やご家族の方が撮影されることを望まない場合、ご旅行開始時にスタッフまたはカメラマンにお伝えください。
